If you have enough money left over after paying your priority creditors and essential expenses, you may be able to arrange an Individual Voluntary Arrangement (IVA).
Please note that that although the consumer may become debt free at the end of the IVA/PTD period, the effect on their credit rating is likely to remain on file for 6 years.
Please note that with an IVA (in the fourth year) and in a PTD the supervisor may require the debtor, if they are a homeowner, to revalue their home and realise the equity to pay off some or all of the debt.
Please note that that only unsecured debts included within the IVA/PTD may be written off at the end of the period and that those not included such as secured debts, Government fines and child support payments will remain.
An IVA is a legal agreement with creditors (usually non-priority creditors) to repay your debts. This could either be in part or in full. The arrangement is negotiated, written up and checked regularly by an independent solicitor or accountant called an Insolvency Practitioner.
