Who can apply for a Debt Relief Order?
Applicant must meet the qualifying criteria
Anyone who meets the qualifying criteria can apply for a Debt Relief Order. In order to qualify, you must meet the following conditions -
- Applicant must be unable to meet their debts
- Debts must not exceed £15,000
- Assets must be worth no more than £300 in total (not including motor vehicle)
- Value of any car they own must not exceed £1000
- Surplus income should not exceed £50 per month
- Must not own or have an interest in a property.
- Applicant must be currently living in England or Wales - or within the last 3 years, have been ordinarily resident OR have a residence in OR have carried on a business in England or Wales
- You must not currently be an Un-discharged Bankrupt
- Must not be involved in an Individual Voluntary Arrangement (IVA) or have an Interim Order
- Must not be subject to a Bankruptcy Restriction Order or Bankruptcy Restriction Undertaking.Must not have been in a Debt Relief Order within the last 6 years
- Must not currently be subject to a Debt Relief Restriction Order or Debt Relief Restriction Undertaking
- Must not have a pending Debtor’s Bankruptcy petition - unless the Court has referred for a Debt Relief Order
- Must not have a pending Creditor’s Bankruptcy petition - unless the creditor has agreed to a Debt Relief Order
- Must not have entered into a Transaction Undervalue - where property has been disposed of for less than its true value
- Must not have made a preference to a creditor or a person, over another
