We receive a lot of calls and emails from the public asking; "What happens if I do not inform my IVA supervisor that I can’t make the contribution?".
When you commit to the IVA, you are agreeing to adhere to the terms and conditions for the duration of the IVA.
If you fail to make the agreed IVA payments then you risk failing the arrangement. You are only permitted to miss a payment with the agreement of the Supervisor.
If you do not inform the Supervisor that you can’t make the payments and this continues, the Insolvency Practitioner can fail the arrangement and start Bankruptcy proceedings against you.
Missed payments will have a direct effect on the final dividend which the creditors receive and if this is less than the minimum they agreed to the IVA will fail.
