We receive a lot of calls and emails from the public asking; "If one of my debts has been excluded from the IVA, am I liable to pay the debt after the IVA has completed?".
When you initially went through the IVA setting up process, you would have been asked if you had included all debts.
If any of the debts were excluded from the IVA, then you will have to pay them once the IVA has completed. However, the creditors would most likely have been pursuing you for payment all through the duration of the IVA.
If you do not include all unsecured debts within the IVA, the creditor still has the right to take legal action against you; something which if it had been included in the IVA, would have been prevented.
