We receive a lot of calls and emails from the public asking; "What happens if I miss an IVA payment?".
When you signed the IVA agreement, you agreed to make the payments as per the proposal. If you then miss a payment, you are breaking the terms of the IVA.
There are times when circumstances change and missing a payment is a result. However, if you feel that this is likely to happen, you must contact the IVA Supervisor to explain.
In most IVA agreements there is a clause that states if more than two payments are missed within the term of the IVA, the arrangement can fail. This would normally lead to creditors seeking your bankruptcy.
If you do not have a genuine reason for failing to make the payment, then the Supervisor will have to inform the Creditors.
If the IVA payments have become unaffordable, then you would be advised to draw up another income and expenditure to reassess the situation and the Supervisor would then consider whether it is viable to call a 2nd creditors meeting to make a new proposal to the creditors.
