We receive a lot of calls and emails from the public asking; "Who takes care of my creditors?”
Once the IVA is approved you are legally contracted to keep up your monthly IVA payments. Once accepted your creditors can never bother you again. This monthly payment will be easily affordable because it is based on your disposable income.
The person who takes care of the IVA creditors is the Licensed Insolvency Practitioner, who is now the IVA supervisor.
The people you owe money to are called creditors. Once you are involved in an IVA, the IP will take care of the creditors. The creditors and collection agents will use letters and telephone calls to liaise with the IVA supervisor. The IP will take care to communicate with the creditors and take care of the arrangement so you don’t have to. The creditors may insist you are made bankrupt if you default on the IVA so you must take care to keep up with payments. The IVA will take of the creditors so that they never bother you again.
As long as you take care to keep up your IVA payments you will only get contact from the IP when they send annual reports to you or need questions answered about your case.
If you still receive any telephone calls or emails from your creditors, it is important to explain that you in an IVA and you should direct them to the IP to resolve the situation. If you have done this and you are still receiving persistent calls from your creditors or their collectors, this may count as harassment.
You must make sure that the IP does not put undue pressure on you to pay more than you can afford.
