We receive a lot of calls and emails from the public asking; "Can I exit out of my IVA before five years?".
Please note that every IVA proposal has a variation clause stating that if the creditors are happy to they will allow a debtor early exit from an IVA
It is possible to finish or settle an IVA early however it will still be necessary to obtain the creditors agreement.
At the creditor’s meeting, the dividend accepted by the creditors is a minimum amount. During the term of the IVA, creditors are still entitled to 100% of their money back and if you are asking them to accept an early settlement, they will be considering a settlement based on the actual amount outstanding and not the reduced repayment you would have paid back if the IVA had continued to the end of the normal term.
If funds become available, you should approach the Supervisor with details of how much and from where the funds originated.
The IVA Supervisor has a duty to ensure that any offer made is fair and equitable to both the debtor and the creditors.
