We receive a lot of calls and emails from the public asking; "I've decided to do an IVA, should I stop paying my creditors now?".
Money Advice Direct IVA unit generally advises to stop paying creditors immediately once an IVA has been decided as the best course of action. Please note that interest will still accrue until the date of the IVA creditors meeting and the amounts will just be added on the IVA proposal.
In most cases IVA clients have no available income to pay creditors, so it is impossible to make any payments. On the other hand some may opt to give the creditors token payments. These are small monthly payments such as £1.00 per month. You may be making token payments because creditors have asked for this or because you prefer to pay something. Some debts carry more severe penalties than others and this means that they must be dealt with first. Priority treatment is not determined by the size of the debt, the period or amount of arrears or the threats being made, but by the actual legal remedy the creditor has against you for recovery.
Money Advice Direct’s IVA team can usually have an IVA drafted in around in 48 hours if necessary, so in most cases you cab stop paying your creditors immediately once an IVA has been decided as the best course of action.
We often advise making token payment to the creditors whist the IVA is being prepared. Small 'token payments' to each creditor are appreciated when you are unable to make full repayments to your creditors. These token payments can be as little as £5.00 each per month to each creditor.
Sometimes it is better to send a 'token payment' than send nothing at all. It can take up to 6 weeks to reach the IVA creditors meeting and the banks often appreciate some payments during the interim period.
The debt collectors who act on behalf of creditors will often telephone or write to you stating that they will be passing your case to a local doorstep collection agent to get some money from you whilst the IVA is being prepared. They often request a token payment that would stop enforcement action whilst the IVA is being prepared. Is it sometimes advisable making a small payment to them just to have peace of mind.
Please note that very few people ACTUALLY get doorstep callers and this practice is just a scare tactic used by collectors.
