Your IVA will contain a 'Windfall Clause'

An IVA contains various standard clauses. One of the standard clauses is called a 'Windfall Clause'. A windfall is an unexpected legacy, or other financial gain. Such as:-
- A lottery win
- A work related bonus
- A gift of money
- An inheritance
So if you win the lottery whilst in an IVA then the funds will have to be paid into the IVA, under the strict terms of the IVA proposal the lottery windfall must benefit the IVA creditors.
What happens if I get a windfall or win the lottery during bankruptcy?
During the course of the bankruptcy, if you win the lottery or come into some money then under the terms of the bankruptcy you may have to pay your debts back either partly of in full.
