We receive a lot of calls and emails from the public asking; "Who will know if I do an IVA?".
Please note that unlike bankruptcy an IVA is not advertised in the newspapers. The only people that will know about your IVA will be the people involved in the IVA and those you chose to tell about it.
Please note that an IVA is a private arrangement between you, your creditors and the IVA Insolvency Practitioner. The only people that will be aware of the IVA are your creditors. Some people don’t even tell their husband or wife about the IVA. The IVA is very different to bankruptcy as it is not advertised or published in 2 local papers and the London Gazette. Please note that your employer will not find out about your IVA unless you tell them.
Please note that an IVA does not have the public stigma that bankruptcy holds. An IVA does not become public knowledge because it is not advertised in the newspapers. The information about your IVA is made public by on the Individual Insolvency Register held by the Department for Business, Enterprise and Regulatory Reform.
It can be quite difficult keeping an IVA secret from those you live with because they should be aware of your budget. The advisers at the IVA unit at Money Advice Direct feel that the best time to tell your spouse of family member about your IVA is once it has been accepted.
The IVA will not become public knowledge however all arrangements are registered with the government's Insolvency Service and this is a public record but is not advertised so the only way people can find out about the IVA is if they are searching for a particular individual. Details of the IVA (Individual Voluntary) are also given to credit reference agencies. The IVA stays on your credit record for six years from the date of the arrangement starting.
