We receive a lot of calls and emails from the public asking; "Will an IVA really write off all of my debts?".
An IVA is for a fixed period. As long as all the payments are made compliantly then all the debts will be written off. This means that, you the client will be completely debt free (subject to terms and conditions). An IVA is therefore a legally binding scheme where all the debts settled as long as the IVA terms are met correctly.
If you want to do an IVA then you must include all the unsecured debts into the IVA proposal. Once in an IVA you will only be protected from the debts stated in the IVA proposal. Debts not stated in the IVA will not be written off and so can still persue you.
Please note than an IVA is legally binding so if payments are missed for no reason then the IVA will fail to write off the debts. The UK Insolvency Helpline feels these adverts are misleading because they do not make clear the fees payable under the terms of an IVA In reality, very few customers would be able to write off as much of their debts as the advertisers claimed.
