There are fundamental changes required to UK High Street banking on bank overcharge fees. Banks overcharge fees are costing bank account holders millions for mistakes such as go overdrawn without permission. If you would like to claim back bank charges then please click here to APPLY NOW!
The advice team at Money Advice Direct feels that the banks' overdraft charges are unfair. The problem is that the banks say they are entirely legal.
Several hundred thousand bank customers are estimated to have won more than half a billion pounds in refunds from their banks in 2007 after accusing them, often in local court proceedings, of imposing excessive overdraft fees that were unfair and illegal.
These fees can amount to more than £30 for going into the red or having a cheque bounced, and in some cases customers have been refunded thousands of pounds each.
The banks argue that if they are no longer allowed to charge these fees they could be forced to make up for lost income by levying new charges on other customers, bringing about the end of so-called "free banking" in the UK.
Many high street banks have, in the past year, been rewriting their contracts for running a current account to avoid any application of the 1999 unfair terms in consumer contracts regulations.
These regulations would allow the OFT to rule on the fairness of overdraft charges, as long as the charges are not fees for a service provided under the core terms of the contract.
The banks maintain their charges are indeed levied in return for a service, the provision of which is fundamental to the operation of current accounts, and therefore the regulations are not relevant.
