The law stated in the Unfair Terms in Consumer Contracts Regulations (1999) prohibits banks from charging more in penalties than it costs them to administer their customers' defaults.
In April 2006, the OFT published a report which stated that they judged credit card penalties averaging £25 per default to be unlawful. The OFT set a new £12 maximum for credit card penalties.
